1. Agreement to terms

These Terms & Conditions ("Terms") govern your access to and use of makethemaker.com (the "Site"), operated by Make The Maker Inc. ("Make The Maker", "we", "us"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. The Site and our services

The Site presents information about Make The Maker and our services (design, software development, e-commerce, SEO, hosting, maintenance, and support) and lets you contact us. Content on the Site is for general information only and does not constitute a binding offer, professional advice, or a guarantee of results. Any engagement for services is subject to a separate written agreement signed by both parties.

3. Intellectual property

The Site and its content — including text, design, graphics, logos, code, and case studies — are owned by Make The Maker or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, revocable licence to view the Site for personal, non-commercial purposes. You may not copy, reproduce, republish, scrape, or create derivative works from the Site without our prior written permission. "Make The Maker" and our logos are our marks and may not be used without permission. Client names and logos shown in case studies remain the property of their respective owners and are used with permission.

4. Acceptable use

You agree not to:

• use the Site unlawfully or in breach of these Terms;
• attempt to gain unauthorized access to the Site, its servers, or the admin/CMS;
• probe, scan, or test the vulnerability of the Site, or breach its security or authentication;
• introduce malware or interfere with the Site's normal operation;
• scrape or harvest data, or use automated systems beyond what a standard browser/robots.txt permits;
• submit false, infringing, or unlawful content through any form.

5. Submissions through the Site

When you submit information through a form, you confirm it is accurate and that you have the right to provide it. We handle the personal information you submit in accordance with our Privacy Policy. Do not submit confidential or sensitive information through the public contact form; use a secure channel we agree on for confidential project details.

6. Third-party links

The Site may link to third-party websites or services we do not control. We are not responsible for their content, policies, or practices. Accessing them is at your own risk and subject to their terms.

7. Disclaimers

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, non-infringement, accuracy, or uninterrupted/error-free operation, to the fullest extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, Make The Maker and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Site. Our total liability relating to the Site will not exceed CAD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Make The Maker from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

10. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect personal information, including that the Site is hosted in Germany (EU).

11. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Vancouver, British Columbia for any dispute, subject to any non-waivable rights under your local consumer-protection laws.

12. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted here with a new effective date. Your continued use of the Site after changes means you accept the updated Terms.
