1. Who we are
This Privacy Policy explains how Make The Maker Inc. ("Make The Maker", "we", "us", "our"), a software studio headquartered in Vancouver, British Columbia, Canada, collects, uses, discloses, and protects personal information when you visit makethemaker.com (the "Site") or contact us through it.

2. Scope
This policy covers personal information collected through the Site. It does not cover personal information processed under a separate written services agreement with a client (that engagement is governed by the contract between us), or third-party websites we link to.
3. What personal information we collect
a) Information you give us. When you submit the contact / "Start a project" form, we collect the information you provide — typically your name, email address, company (optional), and the contents of your message. If you opt in to marketing emails, we also record that consent.
b) Information collected automatically. When you browse the Site, and only after you consent to analytics cookies, we and our analytics provider collect technical and usage information such as your IP address, device and browser type, pages viewed, referring page, and approximate location. See our Cookie Policy for details. Strictly necessary functions (e.g. remembering your cookie choice) do not require consent.
We do not knowingly collect sensitive information, and we do not collect personal information from children under 13.
4. Why we use your personal information (purposes)
We use personal information to:
- respond to your inquiry and discuss potential or active work;
- provide, operate, and improve the Site;
- measure and understand how the Site is used (analytics), with your consent;
- send marketing communications only where you have expressly opted in (you can unsubscribe at any time);
- comply with legal obligations and protect our legal rights.
5. Consent and legal basis
We collect, use, and disclose personal information with your knowledge and consent, except where the law permits or requires otherwise (consistent with Canada's PIPEDA, British Columbia's PIPA, and Québec's Law 25). For visitors in the European Union/EEA, our lawful bases under the GDPR are your consent (analytics and marketing), the performance of steps prior to a contract (responding to your inquiry), and our legitimate interests in operating and securing the Site.
You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. To withdraw analytics/marketing consent, use the "Cookie preferences" control in the Site footer or the unsubscribe link in any marketing email, or contact us. Withdrawing consent may limit our ability to respond to you.
6. Cookies and analytics
The Site uses cookies and similar technologies. Analytics and marketing cookies are loaded through Google Tag Manager and may include Google Analytics 4. These are set only after you opt in via our consent banner; until then they are disabled (Google Consent Mode defaults to "denied"). 7. Who we share personal information with
We do not sell your personal information. We share it only with:
- Service providers who process information on our behalf under contract — including our website hosting provider, our analytics provider (Google), and our email provider — and only as needed to provide their service;
- Authorities or third parties where required by law, to enforce our terms, or to protect rights, safety, and security.
8. International storage and transfer (outside Canada)
Our Site and its data are hosted on a server located in Germany (European Union). This means your personal information is stored and processed outside of Canada and Québec, and may be accessible to service providers in other countries (e.g. the United States for Google services). Information stored abroad is subject to the laws of those jurisdictions.
We take reasonable contractual and technical measures to ensure your information receives a comparable level of protection wherever it is processed. Québec residents: this is a transfer of personal information outside Québec; we have assessed the transfer as required by Law 25. If you have questions about international processing, contact our person responsible for privacy (Section 1).
9. Retention
We keep personal information only as long as necessary for the purposes described above or as required by law. Contact-form inquiries are retained for as long as needed to handle your request and for a reasonable follow-up period, after which they are deleted or anonymized. Analytics data is retained per the retention settings configured in Google Analytics.
10. Safeguards
We protect personal information with administrative, technical, and physical safeguards appropriate to its sensitivity, including access controls, encryption in transit (HTTPS), and vetted service providers. No method of transmission or storage is completely secure, but we work to protect your information and to notify you and the relevant regulators of a breach where the law requires.
11. Your rights
Subject to applicable law, you may:
- access the personal information we hold about you and ask how it is used;
- request correction of inaccurate or incomplete information;
- withdraw consent to our collection, use, or disclosure;
- request deletion of your personal information;
- (EU/EEA and Québec) request portability of information you provided to us; and
- (Québec) request that we cease disseminating information or de-index a link where the law allows.
To exercise any right, email privacy@makethemaker.com. We will respond within the timeframe required by law (generally 30 days). You also have the right to complain to a regulator: the Office of the Privacy Commissioner of Canada, the BC Office of the Information and Privacy Commissioner, the Commission d'accès à l'information du Québec, or your EU supervisory authority.
12. Changes to this policy
We may update this policy from time to time. We will post the updated version here with a new "Last updated" date and, where required, obtain fresh consent.
